1. ELIGIBILITY:
The America's Greenest School Contest (the “Contest”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are enrolled in a public or private school, not a home school, and between the grades of Kindergarten through 12th Grade at the time of entry. A teacher may submit an entry on behalf of a student or group of students. Employees of IC Bus, LLC (“Sponsor”), Fathom Communications, Tic Toc, Inc., Ketchum, Inc., and their respective parent companies, subsidiaries, affiliates, sales representatives, dealers, distributors, licensees or agents, advertising and promotional agencies, and all such employees’ immediate family members and those living in the same household of each such employee, are not eligible to participate in this Contest. Void where prohibited.

3. SUBMISSION PERIOD:
The Contest Submission Phase begins at 12:00 a.m. ET on January 18, 2010 and ends at 11:59 p.m. ET on March 8, 2010. Administrator’s computer is the official time keeping device for this Promotion.
4. HOW TO ENTER:
Visit www.americasgreenestschool.com during the Submission Phase and click on "Enter Now", then follow the instructions to complete and submit the registration form and upload your submission. Your submission should demonstrate original creative thinking on how to make your elementary or secondary education school (grades K-12) more eco-friendly, and must demonstrate commitment to school bus ridership as part of making the school experience greener. Your submission may be in the form of an essay (not to exceed 500 words), photo collection (not to exceed 10 photos), video (not to exceed three minutes), music (not to exceed three minutes), or photos of a model, diorama or piece of art ("Submission"). Essays must be submitted in English. All entries must be submitted electronically by visiting the contest microsite (americasgreenestschool.com). A teacher may enter a Submission on behalf of a student or a group of students. If a teacher enters a Submission on behalf of a student or group of students under the age of 13 (or under the age of 18 if the student is a resident of Maine), the teacher MUST have permission from the child or children who created the Submission and each child’s parent/legal guardian. The teacher must provide his or her contact information at the time of entry, along with the first name(s) of the child or children who authored the submission.
Submissions must not be inappropriate, indecent or obscene, as determined by Sponsor in its sole discretion. Proof of entry or sending is not proof of receipt by Sponsor. All Submissions become the exclusive property of Sponsor, and none will be acknowledged or returned. Sponsor shall have the right to edit, adapt, and publish any or all of the Submissions entered, and may use them in any media without attribution or compensation to the entrant, his or her successors or assigns, or any other entity. Entry of a Submission in this Promotion constitutes entrant’s irrevocable assignment, conveyance and transference to Sponsor of all rights, titles and interests in the Submission, including, without limitation, all copyrights. In addition, by entering, entrants represent and warrant that the Submissions are original; do not infringe any other person’s or entity’s rights; do not contain personal information about any individual; and have not been submitted previously in a contest of any kind. If any individuals are identifiable in your Submission, you must have written permission from each of those individuals to use their image/likeness in connection with your Submission.
Multiple entrants are not permitted to share the same email address, with the exception of a teacher submitting on behalf of multiple students. Teachers may enter more than one Submission using his/her same email address, but is limited to one entry per student Submission or group Submission. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.
5. DETERMINATION OF CONTEST WINNER:
a. Judging Phase: During the Judging Phase, a panel of qualified judges determined by Sponsor in its sole discretion will select the top ten (10) Submissions from among all eligible Submissions based on the following criteria (“Judging Criteria”):
The students who created the top 10 Submissions will be deemed “Finalists.” In the event of a tie, the entrant whose Submission received the highest score in the creativity category, as determined by the qualified judges, will be deemed the Finalist. Sponsor reserves the right to select fewer than ten (10) Finalists, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions. Once the Finalists have been selected, Sponsor will contact each Finalist by phone and/or email and then announce the Finalists on, or around, March 22, 2010. For entries submitted by a teacher, Sponsor will first contact the teacher and the teacher will be responsible for contacting the parents of the students who authored the submission. Each student or group of students may only have one Submission selected to compete in the Voting Phase.
b. Voting Phase: The Finalists’ Submissions will be posted in an online gallery for public voting at www.americasgreenestschool.com from March 22, 2010 through April 2, 2010 (the “Voting Phase”). Anyone may vote (including those who have entered) for the Submission he or she believes demonstrates the most creative ways that a school could be more eco-friendly. Limit: Each voter may vote one (1) time per day during the Voting Phase. Any attempt to vote more than once per day by using multiple email addresses, identities, registrations and logins, or any other methods will void all votes and the entrant may be disqualified. Use of any automated system to vote is prohibited and may result in disqualification. The child or group that creates the Submission which receives the highest number of valid votes during the Voting Phase will be deemed the potential Author Prize winner. If the person who entered the Submission is not the Submission Author, he/she will be the potential winner of the Entrant Prize. The School described in the Submission will be the potential School Prize winner, and the School Employee nominated during registration will be the potential School Employee Prize winner. If the winning Submission was authored by the entrant, the entrant will be a potential winner of the Author Prize and the Entrant Prize will not be awarded. In the event of a tie, the Finalist whose Submission received the highest score during the Judging Phase, as determined by the qualified judges, will be deemed the potential winner from among the tied Submissions. Sponsor reserves the right, in its sole discretion, to select an alternate winner from among the Finalists should the voting appear to have been tampered with or manipulated in any way.
6. VOTING SWEEPSTAKES:
Everyone who votes will be given the opportunity to enter into a daily drawing for the chance to win a $100 general use prepaid card. You must be at least 13 years of age and a legal residents of the fifty (50) United States and the District of Columbia to enter. Do not enter if you are not eligible. Daily Prizes (12, one per day of the Voting Phase): a $100 general use prepaid gift card. Sponsor will select one winner per day of the Voting Phase in a series of random drawings from all entries received each day on or about April 5, 2010. Total value of all prize: $1,200. Winners will be notified by email. Limit: one (1) entry per day and one (1) prize per person/household.
7. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY, AND THE POTENTIAL WINNER HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.
8. WINNER VERIFICATION:
Each selected potential winner must continue to comply with all terms and conditions of these Official Rules; and winning is contingent upon fulfilling all requirements. Potential Contest Prize winners will be notified by mail, email or phone on or around April 6, 2010. Each potential Contest Prize winner (parent/legal guardian if winner is a minor in his/her state of residence) will be required to execute and return to Administrator, within two (2) days of the date notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity Release (“Affidavit”) in order to claim his/her prize. If a potential winner cannot be contacted, fails to execute and return the Affidavit within the required time period, or prize is returned as undeliverable, potential winner forfeits prize. In the event that the potential winner of the Entrant Prize is disqualified for any reason, the Author and School will not be awarded to the author and school designated by the entrant. Sponsor may, in its sole discretion, select an alternate potential Entrant Prize winner, and associated Author and School Prize winners, based on the number of votes received during the Voting Phase. Prizes will be fulfilled approximately 8-10 weeks after the conclusion of the Contest. Acceptance of any prize shall constitute and signify winner’s agreement and consent that Sponsor may use the winner’s, name, city, state, likeness, nomination and/or prize information in connection with the Contest, worldwide, including the Internet, without limitation and without further payment or consideration, except where prohibited by law.
9. PUBLICITY:
Acceptance of any prize shall constitute and signify the Finalist’s and/or winner’s agreement and consent that Sponsor may use the Finalist’s and/or winner’s name, age, address (city, state), likeness, Contest Entry, and/or prize information for promotional purposes worldwide, including the Internet, without limitation and without further payment or consideration, except where prohibited by law.
10. PRIZES:
ONE (1) AUTHOR PRIZE: $3,000 ONE (1) ENTRANT/SPONSOR PRIZE: $500 which is intended to be used towards supplies for the author’s classroom, ONE (1) SCHOOL PRIZE: an IC Bus™ CE Series hybrid electric bus (approximate retail value of $150,000) and a LEED certified "green" school audit and mini-makeover (approximate retail value of $20,000). Sponsor will determine all specifications of bus including but not limited to color of exterior and interior, and all other features or upgrades will be allowed only if permitted by delivery dealer and paid for by winning school. Winning school will be required to provide proof of insurance at time of delivery. Winning school is responsible for title, license, registration, bus insurance and other fees associated with prize. Winner must take delivery of prize from location designated by Sponsor. Prizing details for the IC Bus™ CE Series hybrid electric bus are as follows (See appendix for full Donation Agreement and Release):
The Bus will be used solely by the Donee (as defined in the Donation Agreement and Release) and solely for education purposes and will not be sold, utilized or otherwise transferred for non-education purposes. For avoidance of doubt, in the event that Donee hires an outside contractor for school bus services, Donee may loan or sell the Bus to its outside contractor for education related delivery services or use.
Donee and Donee Authorized Representative agree to cooperate with Donor (as defined in the Donation Agreement and Release) requests associated with media and press conferences and media events (such as awarding of prize and delivery of Bus) including confidentiality, schedule and timing, media interviews, media training and messaging.
The Bus specifications at order will include those as required by the laws of the state in which Donee is located as well as in accordance with current EPA emissions standards.
After accepting delivery of the Bus, Donee will be fully responsible for all costs associated with the Bus. Bus will be covered under standard warranty and will be serviced by Dealer in accordance with the IC Bus warranty.
Donee indemnifies and agrees to hold harmless Donor from any liability associated with the Bus or arising from or associated with a violation of The Donational agreement.
When Bus is no longer useful the Bus will be scrapped at Donee expense.
For all Prizes: No cash or other substitution, assignment or transfer of any prizes permitted, except by Sponsor, who reserves the right to substitute a prize or prize component with cash or another prize of comparable or greater value. Winner is responsible for all federal, state and local taxes and fees associated with Author/Entrant prize.
11. GENERAL RULES:
By entering or participating in the Promotion, entrants agree to be bound by these Official Rules. Sponsor assumes no responsibility for electronic hardware, programming or software malfunctions, or failures, or line connections, accessibility or availability, or technical failures of any kind, or unauthorized human intervention, or the incorrect or inaccurate capture of any entry or other information, or for the failure to capture any such information. Sponsor is not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; or (4) technical or human error which may occur in the administration of the Promotion or the processing of entries. Further, if, for any reason, the Promotion is not capable of running as planned by reason of infection by virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of the Sponsor, may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion, and select the winner for the Promotion, from the entries received prior to the action taken or in other such manner as deemed fair and appropriate by Sponsor. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or to be acting in violation of these Official Rules or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Promotion is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Entrants, by participating in this Promotion, hereby waive and release, and agree to hold harmless the Sponsor, Fathom Communications, Ketchum, Tic Toc, all promotions and advertising agencies, and their respective parents, subsidiaries, affiliates, distributors, advertising and promotions agencies and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of the prize in the Promotion, or their participation in the Promotion, or their participation in any promotion or prize related activity, or any travel related to the Promotion or any travel for any prize related activity. Winner also further acknowledges that Sponsor, its affiliates, subsidiaries, employees, officers, directors, and promotions and advertising agencies have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law relative to any prize or these Promotion including but not limited to quality, condition or fitness for a particular purpose.
12. DISPUTES:
Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court or the appropriate Illinois State Court located in Du Page, Illinois; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois.

14. WINNERS’ LIST:
